1The Golden Hour Service

Golden Hour is an event-discovery and planning service designed to help users discover events, review curated event information, save events or other items to a plan, and access links to third-party websites where additional information, tickets, reservations, or other services may be available.

Unless Golden Hour expressly states otherwise, Golden Hour is not the organizer, promoter, producer, venue, ticket seller, ticket broker, travel provider, restaurant, merchant, or operator of events or services displayed through the Service.

Golden Hour generally does not control the events, venues, merchants, organizers, ticketing providers, or websites to which the Service links.

2Eligibility

You must be at least 13 years old to create an account or use the Service.

If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian.

Individual events may have their own age restrictions, including events restricted to users who are 18, 21, or another age. You are responsible for determining whether you satisfy an event's requirements before purchasing tickets, making reservations, traveling to, or attending an event.

The Service is not directed to children under 13.

3Accounts and Phone Number Verification

Golden Hour currently allows users to create an account using a mobile telephone number.

When you register, we may send a one-time verification code or similar authentication message by SMS. By providing your telephone number, you authorize Golden Hour and its service providers to send transactional messages necessary to verify, secure, access, or administer your account. Message and data rates imposed by your wireless carrier may apply.

Consent to these Terms is not consent to receive promotional SMS marketing from Golden Hour.

You must provide a telephone number that you are authorized to use and maintain control over. You are responsible for maintaining access to your telephone number and for the activity occurring through your account.

If your telephone number changes or is reassigned, you should update or delete your Golden Hour account promptly.

You may not sell, transfer, share, or provide another person unauthorized access to your account.

4Free Access and Views

Golden Hour may permit users to access portions of the Service without charge.

Certain features, including access to detailed event pages, may be subject to usage limits. Golden Hour may refer to an access to a detailed event page as a “View.”

The number of complimentary Views available to a user may be displayed within the Service and may change from time to time.

A View is considered used when Golden Hour's systems record access to content designated as requiring a View. Golden Hour may implement reasonable technical rules intended to prevent accidental duplicate charges, abuse, automated viewing, or circumvention of View limits.

Availability of free features does not create a right to receive any particular number of free Views indefinitely. Golden Hour may modify its free tier prospectively.

5Paid Subscriptions

Golden Hour may offer monthly subscription plans providing a specified number of Views or other features during each subscription billing period.

For example, subscription tiers may provide 50, 100, 500, or another number of Views per month. The specific number of Views, price, billing period, and features applicable to your subscription will be displayed before purchase.

Unless otherwise stated at the time of purchase:

• subscription Views are available during the applicable billing period;
• unused subscription Views do not roll over into a later billing period;
• a new View allowance is provided at the beginning of each successful subscription period; and
• subscriptions automatically renew until canceled.

Subscription prices and available tiers may change. Any change affecting an existing auto-renewing subscription will be handled in accordance with applicable law and the rules of the platform through which the subscription was purchased.

6View Packs

Golden Hour may separately offer one-time purchases of additional Views (“View Packs”).

View Packs are separate from monthly subscription allowances. A user may have a subscription, a View Pack balance, both, or neither.

Unless otherwise disclosed before purchase, View Pack credits:

• are purchased once and do not automatically renew;
• do not expire solely because of the passage of time while your Golden Hour account remains active and the Service remains available;
• are intended solely for use with the Golden Hour Service;
• have no cash value;
• may not be transferred, resold, traded, or redeemed for cash; and
• are not refundable except where required by applicable law or permitted by the payment platform through which the purchase was made.

Unless otherwise indicated in the Service, available monthly subscription Views will be used before View Pack credits.

View Pack credits do not represent stored money, a deposit account, or property redeemable outside the Golden Hour Service.

7Purchases Through Apple and Other Payment Providers

Purchases made through the Golden Hour iOS application may be processed by Apple through Apple's In-App Purchase system.

Purchases made through the Golden Hour website or another platform may be processed by a separate payment provider.

Your purchase may therefore also be subject to the payment provider's applicable terms, billing rules, refund procedures, and account-management requirements.

Golden Hour does not control Apple's billing systems or other independent payment platforms.

Prices shown to you at the time of purchase may include or be subject to taxes as required by applicable law.

8Cancellation, Downgrades, and Refunds

You may cancel an auto-renewing subscription at any time through the platform through which you purchased it.

Cancellation normally stops future renewals. Unless otherwise required by law or determined by the applicable payment platform, cancellation does not generate a prorated refund for the remaining portion of a billing period, and paid subscription access will continue through the end of the applicable paid period.

You may downgrade to a lower paid tier or return to a free tier where those options are available. Unless the purchase interface states otherwise, a downgrade generally takes effect at the beginning of the next billing period.

View Pack purchases are final and non-refundable except where a refund is required by law or authorized by the payment platform that processed the purchase.

For purchases processed by Apple, Apple may independently determine eligibility for refunds under Apple's policies.

9Account Deletion

You may request or initiate deletion of your Golden Hour account at any time through the account settings or other deletion mechanism provided within the Service.

Account deletion is different from logging out.

Account deletion is also different from canceling an auto-renewing subscription.

If you purchased a subscription through Apple or another third-party payment platform, deleting your Golden Hour account may not automatically cancel that subscription. You are responsible for canceling an active subscription through the applicable payment platform if you do not want future charges.

When you permanently delete your account, unused subscription Views, View Pack credits, saved plans, saved events, and other account-specific benefits may be permanently forfeited and will not be refundable except where required by applicable law.

Golden Hour may retain limited information following deletion when reasonably necessary for legal compliance, fraud prevention, accounting, dispute resolution, security, or other legitimate purposes described in our Privacy Policy.

10Event Information Is Informational Only

Golden Hour attempts to provide useful event information, but event listings are not comprehensive and are not guaranteed to include every event occurring in a particular city, area, category, or period.

Event information may originate from publicly available sources, event organizers, venues, ticketing providers, third-party websites, or other sources.

Event information can change without notice.

Golden Hour does not guarantee the accuracy, completeness, availability, price, date, time, location, lineup, capacity, ticket availability, age restriction, accessibility, refund policy, safety, quality, or other characteristics of any event.

An event displayed in Golden Hour may be changed, postponed, relocated, sold out, or canceled.

You should verify important event information directly with the organizer, venue, ticket provider, or other official source before purchasing tickets, making travel arrangements, or attending an event.

11Third-Party Websites and Transactions

The Service may contain links to third-party websites and services.

Golden Hour provides these links for discovery and convenience. A link does not mean that Golden Hour operates, controls, endorses, guarantees, or is affiliated with the linked party unless we expressly say so.

When you leave Golden Hour and interact with a third-party website, that third party's terms, privacy practices, refund policies, and other rules apply.

Golden Hour is not a party to transactions entered into between you and a third-party event organizer, venue, ticket seller, merchant, or other service provider.

Golden Hour is not responsible for tickets that are invalid, unavailable, canceled, mispriced, fraudulent, non-refundable, or otherwise disputed, or for losses arising from an event organizer, ticketing company, venue, merchant, or other third party.

Any request for a refund for an event ticket or other third-party purchase should be directed to the party that sold or provided that product or service.

12Events and Personal Safety

Your decision to visit a venue, attend an event, purchase a ticket, travel to a location, interact with another person, or participate in an activity is your own decision.

Golden Hour does not inspect or supervise events and does not make representations regarding the security of venues, neighborhoods, transportation, crowds, performers, organizers, or activities.

You are responsible for exercising appropriate judgment and complying with applicable laws, venue rules, age restrictions, health requirements, and safety instructions.

13Images and Illustrative Content

Some images displayed by Golden Hour may be generated or modified using artificial intelligence, created for illustrative purposes, obtained from licensed or permitted sources, or otherwise not originate from the event organizer.

An image shown with an event listing may therefore not depict the actual event, venue, performers, attendees, atmosphere, décor, crowd size, weather, food, merchandise, or other conditions you will experience.

Images are provided as discovery and presentation aids and should not be treated as factual representations or guarantees concerning an event.

14Saved Plans

Golden Hour may allow you to add events or other items to a personal plan, itinerary, favorites list, or similar feature.

Saving an event does not reserve admission, purchase a ticket, confirm availability, create a reservation, or guarantee that the event will occur.

Golden Hour may modify or discontinue planning functionality, and event information contained in a saved plan may become outdated.

15Golden Hour Content and Intellectual Property

The Service, including its software, interface, branding, logos, design, selection and arrangement of content, original written descriptions, curated summaries, original editorial content, and other materials created by Golden Hour, is owned by or licensed to Golden Hour and is protected by applicable intellectual-property laws.

Golden Hour claims rights in its original expression, compilation, selection, organization, and presentation of event information, but does not claim ownership of underlying facts or third-party materials that belong to their respective owners.

Event names, venue names, performer names, logos, photographs, trademarks, and other third-party materials may belong to their respective owners.

Displaying third-party information does not imply sponsorship, endorsement, partnership, or affiliation with Golden Hour unless expressly stated.

You may use the Service for personal, non-commercial purposes in accordance with these Terms.

16Prohibited Uses

You may not:

• scrape, crawl, spider, harvest, bulk-download, or systematically extract Golden Hour content or event data without written permission;
• use bots, scripts, automated systems, or other means to circumvent View limits or paywalls;
• attempt to manipulate View counts or account balances;
• copy, reproduce, republish, distribute, sell, sublicense, or commercially exploit Golden Hour's curated content except as permitted by law;
• interfere with the security or operation of the Service;
• attempt to access accounts, systems, or data without authorization;
• reverse engineer the Service except where applicable law expressly permits it;
• use fraudulent payment methods or engage in chargeback abuse;
• impersonate another person or misrepresent your relationship with an event or third party; or
• use the Service for unlawful, abusive, fraudulent, or harmful purposes.

Golden Hour may suspend or terminate accounts engaged in prohibited activity.

17Corrections and Removal Requests

Golden Hour wants event information to be useful and accurate.

Event organizers, rights holders, or users who believe information is materially inaccurate or that content should be corrected or removed may contact us at goldenhouradmin@gmail.com.

Golden Hour may modify, correct, or remove listings at its discretion.

18Changes to the Service

Golden Hour is continuously evolving.

We may add, change, limit, suspend, or discontinue features, content sources, event coverage, free allowances, subscription options, or other aspects of the Service.

Where reasonably practicable, material changes affecting an existing paid service will be communicated in advance.

Nothing in these Terms requires Golden Hour to continue operating the Service indefinitely.

19Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

GOLDEN HOUR DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

GOLDEN HOUR DOES NOT WARRANT THAT EVENT INFORMATION WILL BE COMPLETE OR ERROR-FREE, THAT AN EVENT WILL OCCUR AS DESCRIBED, THAT THIRD-PARTY LINKS WILL REMAIN AVAILABLE, OR THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTIONS OR ERRORS.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

20Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN HOUR AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, TRAVEL COSTS, EVENT COSTS, TICKET LOSSES, OR SIMILAR LOSSES ARISING FROM OR RELATING TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN HOUR'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GOLDEN HOUR FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100.

These limitations do not apply where applicable law prohibits them.

21Indemnification

To the extent permitted by law, you agree to indemnify and hold Golden Hour harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Service, violation of these Terms, infringement of another person's rights, or fraudulent conduct.

22Governing Law and Disputes

These Terms are governed by the laws of Delaware, without regard to conflict-of-laws rules, except to the extent applicable consumer law requires otherwise.

Any dispute that is not required to be resolved in another forum by applicable law will be brought in the state or federal courts located in Delaware, and you and Golden Hour consent to jurisdiction in those courts.

Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection law.

23Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice through the Service or by another reasonable method. The updated Terms will identify their effective date.

Your continued use of the Service after updated Terms become effective constitutes acceptance to the extent permitted by law.

24Apple App Store

If you download or use Golden Hour through Apple's App Store, your use of the application is also subject to applicable Apple terms, including Apple's applicable end-user license terms and App Store rules.

Apple is not responsible for events, third-party event listings, third-party websites, or transactions between you and event providers.

Purchases, subscriptions, cancellations, and refunds processed through Apple may also be governed by Apple's applicable terms and procedures.
